Lasting Power of Attorney (LPA):

 

A Lasting Power of Attorney document is completely separate from a Will & does a completely different thing.

 

If you ever lost mental capacity for example if you ever got Alzheimers; Dementia or even had an accident which resulted in you loosing mental capacity your whole estate would be frozen (not even your spouse could access joint bank accounts); the Court of Protection would take over - you and your whole family would not be able to make ANY decisions for you. 

A Lasting Power of Attorney is a document you can prepare to appoint the people who you trust to take over your affairs if you ever lost mental capacity.

There a are 2 different types:

Property and Finance:

This is a legal document that gives someone you choose (your attorney) the power to make decisions on your behalf about your property and money

Health and Welfare:

This is a legal document that gives someone you choose (your attorney) the authority to make decisions about things like your daily routine, long term care, medical care and life sustaining treatment.

 

It is not something we tend to think about happening but you can't do this document once you have lost capacity, so if it is something you are considering - maybe now is the right time. For more information please get in touch.
